Garage parking charges

Looking for advice?

Can a car dealership in Scotland charge you a daily rate for having your car in their possession? Is this legal?

regards,

Mark

Ask your nearest policeman - he should see you right.

If it was written on the wall at my local dealership when I dropped my car off to be serviced, "WE WILL CHARGE YOU £10 A DAY WHILE YOUR CAR IS GETTING A SERVICE", I would take it elsewhere.

If its on the invoice £10er a day x 5 days = £50 - I would just pay the invoice less the parking charges that you didnt agree to.
  • No its a dispute i have with them over engine failure, at no point was i made aware of this until i received a letter.

Unusual if it's being repaired, if however it's sat there waiting for something to happen that isn't down to the garage it's reasonable for the garage to charge storage.
I would suggest that they can't suddenly spring this on you and back date it but can inform you that if it remains there after a certain date it will accrue charges.

Why? They're not trained in civil law.

I guess they can charge you for taking up parking if you are in dispute and work is not going ahead. You need to get it taken away to store somewhere else. If it is taxed and insured, it can just be parked in a road nearby.

How long has the car been on their site?

Yes, it is perfectly feasible for them to charge you for storage of the car, but whether it's appropriate is part of the much longer story that you seem reluctant to tell us...

Pay them to fix your car or pay them to store it. or you could pay whats owed and take it away.

I have bought a couple of cars from a garage where they have stripped to repair and when telling the customer whats wrong the customer saying they cannot afford to fix it.

Garage have held onto it but space is a premium so after sending letters to the owners they sold them to me. They said apply for the logbook and come back if there are any issues.

The garage would have just billed the customer, but the logbooks arrived no issues. I kept one car and a drunken guy did walk up to me saying thats my car but his mates just pulled him away.

I can only guess your not paying them or stalling the repair?

  • I once had a timing belt breaking. I did not know where I would get it fixed, took to local/nearby garage in weekend. After I spoke to them, they said they could not fix it (they could only act as intermediates to have it fixed elsewhere). They held it for a while and I arranged to have it towed elsewhere. They did not charge me but was not there a week.

The OP asked if it is legal - the LAPD will know if its legal or not. They will say its a civil case so not illegal.
