Deed troubles

Hi my name is jack and im really worried because I dont know what to do, basically my dad owns the house as his name is on the deed, my mum couldnt get her name on the deed at the time as she had debts and still does now, their relationship is falling apart and my mum is being really spiteful, shes trying to get my dads name off the deed and have her name put on it, but if this happens im worried the house will be repossessed as she still has debts.
So my question is is my mum able to get her name on the deed and my dads name off the deed?
Some information to note, no they arent married if that makes a difference, and yes she did pay towards getting the house but could not have her name on the mortgage or deed as she had debts and still does, the mortgage has been paid off.
Thank you so so much in advance xx

Your dad needs to take some proper advice.
It's likely that your mum is entitled to a share in the property, as she contributed to the property and it appears that the reason it wasn't in joint names was due to her credit, (i.e. that there is evidence that their original intention was that they both had an interest in the house)
If your dad can't afford to pay her for her hare in the house then it may be that the house will have to be sold, in which case they would need to agree on what share they were each entitled to, taking into account their original intentions and their contributions.
It's very unlikely that your mum would be entitled to the whole house (i.e. to have your dad's name removed) but it may be necessary for the house to be sold, if he cannot afford to buy her interest. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Hello thank you for helping me. He said he will but I have anxiety so i feel trapped in this whole situation, alright thank you, do you know if my mum would be able to get my dad out of the house since his name is on the deed and her name isnt, does she have any rights to kick him out?0

No she cannot have him thrown out.
Please dont worry, You really are overthinking.
Your mum will be entiteld to something but as far as anyone throwing anyone out, it wont happen.
Just please stop worrying, you will end up making yourself ill. Just roll with it xmake the most of it, we are only here for the weekend.
