Can someone please help me with this case! I'm really stuck!
Please bear with me this is long n confusing
I had a car accident in July 2015. It was not my fault. My car was hit from behind by a van. I was the driver, my partner the front passenger and we had 3 kids in the back.
The case started pretty simple. I sent supporting picture evidence aswell as witness statements. The witnesses were unknown to me, they were taxi drivers driving by.
It's been over a year n a half n now it's going to trial next month, I believe. However, things have become complex over the last 6 months. Some new names unknown to me have been thrown in who have claimed to be passengers in my vehicle and they have made injury claims. The two claimants and The two witnesses also have similar/same surnames. Now my solicitor is telling me he may apply to have his firm removed from court - (what does that mean? He does not want to represent me any more?) he says the court will question how 2 claimants from another city knew details of the accident. Fair enough but that doesn't prove I know them! What if the witnesses turned against me and passed on my details to people they know.
To top it off the third party who hit my car has also claimed that I wasn't the driver and that the driver was a male. And that there was no kids In the back and there was only 2 women n 2 men. These are absolute lies. My partner even stopped a patrol officer at the accident scene but they have no record of it. Wouldn't the pictures I sent to my solicitor not squash all these claims?
I'm really confused - my case was simple and it's become really complex now with all these false and fraudulent claims. I'm nervous as hell not because I'm at fault but because I can't talk for !!!! in trial. I don't want to be cornered n stutter and make myself look like I'm in the wrong.
should I get legal aid? Will they help? I've just been told that if any elements of my case are dishonest I will have to pay all fees (not the solicitor). I thought it's no win no fee?
Please shed some light I'm depressed n a nervous wreck

OP's previous thread which fills in some of the gaps.

Was this incident reported to your insurance company ? If so, don't worry. Just forward all correspondence to them and let them deal with it - that's what you pay them for. And don't worry about a court appearance, again it's their job to deal with all that.
The only thing it is worth doing is phoning them up to confirm they've received any documents you send them. Other than that, just relax and let them deal with it.0 -

It's a PI claim by the OP, her insurer won't deal with that.0
