  • The hinges on new seat are slightly off, whenone sits flat, the other is slightly raised meaning that, for want of a better word, it doesnt fit flush.
Can you correct the misalignment by using a shim of some sort?

You shouldn't have to do that but, in the light of B&Q's refusal to refund or replace, it might be easier.

If you got a replacement - would that also be "faulty" ? Or is it just not compatible with you toilet.

I bought a toilet from B&Q, but realised after a few weeks that a defect in the ceramic round pipe at the back, mean that the rubber connector didnt get a seal properly.

I took it back - guy on the counter wasnt happy with it being in the store and had it condemned straight to the skip and refunded no problem.

Try another B&Q store ? Failing that letter before action then take it to court if youre sure its not fit for purpose/faulty.

Take it to another store (or even back to the same one). Say it is faulty as it must be slightly twisted/deformed and so wont sit flat on your toilet. Do not say you have already tried to take it back!

It sounds like the person you spoke to has taken this clause of their t&c's out of context:

    8.6.3 your right of cancellation does not apply to Products which are not suitable for return due to health or hygiene reasons, if you have opened the Product packaging after delivery or collection;

However that clause is all about your right to cancel, not about faulty goods, which are covered by this:

9.2 In addition to the right to cancel an order as described in clause 8, if there is a problem with your order or the Product(s) you purchase is(are) faulty, we may make good any shortage or non-delivery, or offer a repair, exchange or refund as appropriate in accordance with your consumer rights. Please call us on 0333 0143357 (or 1800 946327 if you are calling from the Republic of Ireland) (lines are open 8am to 8pm weekdays, 8am to 8pm Saturday and 10am to 4pm Sunday) or e-mail us at home.delivery@b-and-q.co.uk to arrange. Alternatively, you can return faulty Products in store.

In other words, they have to offer a 'repair, exchange or refund' if the item is faulty.
For every complex problem there is an answer that is clear, simple and wrong.
  • Try calling them and tell them you want a replacement as per clause 9.2 in their term as shown above. Stress that it is faulty and you are not changing your mind.

Everyone is jumping on the "faulty" band wagon, but is it really faulty?

Did the OP measure the centers of the holes on their toilet and match them to the seat they bought?

by the sounds of it they didn't, the seat has XXXmm centers and the toilet has YYYmm centers.

its NOT B&Q's fault if the OP didn't measure and they don't need to accept a return.

This is a common problem with old toilets, they had imperial distances, and new seat have metric, but there are special seats that have an element of adjustment built in
  • I agree if its not faulty and it simply doesn't fit then OP doesn't really have any recourse, but I'm taking them at their word that it is the right size and therefore faulty.

    Opened it up
    Removed old seat
    Placed new seat on loo.

I think you are being a bit generous there.

    from the opening post.

bought seat, then removed old one - no measuring of the holes

when one sits flush the other doesn't - SCREAMS that the holes are slightly narrower than the seat, and forcing the seat screws through them causes an angle on them, meaning one of the hinges has to be bent, but you can make either one of them straight.
