Warner Holiday Insurance

Last year in May 2016 I was due to go away for a 3 day break to the Isle of Wight staying at a Warner Hotel.
However I was an emergency admission to Hospital and spent 17 days in Hospital.
I came out 8 days before I was due to go away but because I would be driving I wasn't allowed to go by my GP.
For the past 7 months I have been recovering and only now am I well enough to take this on.
It seems because I didn't take out Warner's Insurance I am not allowed to get a refund.
In their Terms & Conditions it does state this;
My question is, Are they breaking the law in doing this?

Did you claim on your own Travel Insurance ?Never pay on an estimated bill. Always read and understand your bill0

Of course you would not get a refund from Warner insurance, you didn't take it out and pay for it .
No law has been broken , I suggest you just move on.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Okay, however being forced to take out their Insurance Cover is if I'm not mistaken, against the law.
I will seek legal advice on this, but I thought I would ask on here first.0 -

(You weren't "forced" to take out their cover - and you didn't!)
(Assuming this is not a wind up.) Don't waste your money paying for legal advice over that!0 -
I think you misunderstand their conditions. Warners will only give you your money back if you use their insurance. If you arrange your own insurance, which most people will do as it's usually cheaper, your own insurance company will repay you.0
