Telecomunications default

Good evening.

I am in a battle with orange (surprise surprise) after defaulting me when phones4u went into administration. My contract came to an end and I had sent instruction via phones4u to terminate the contract (they didn't but said they had) I now have a default. I began contact through resolver and had a slightly heated conversation about it resulting in them admitting they do not have the billing information for my account and they would send a letter of deadlock the next day. This was six weeks ago and no letter has come and they are ignoring all correspondance.

Would I be correct in thinking that without the billing information and most likely the contract they cannot maintain that the default is justified?

    Does resolver give you an option to send it to the Ombudsman?

    I know it's the same company just phone EE if it's a different phone number. If they have no record of you, how can they default you then.

    When defaulted they likely sold the account
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    But Orange would still have the details wouldn't they?

  • Hello, thanks for the replies. I had paid the outstanding balance that they had not informed me off so it was settled with orange and not sold on. It's a bit of a mire. I had a default on my score under an ee account and not the orange account which I now have. I fought it and had it removed only for it to appear on the Orange account. I'm going to call noddle.com today if I have time to query any changes. But I really do believe they are trying it on.

    Have you missed 3+ payments in a row? Thats a default normally.

  • Yes.payments were missed but orange had failed to communicate with me for 7 months as they let this go on and on without writing to me or attempting contact on another number on ee. What I'm getting at is that I had sent instruction to terminate the contract and in the meantime phones4u who had the contract went into administration. Something out of my control. I think the default is very unfair, I paid off the debt when they finally told me there was one (which I found out through visiting an ee branch about something else!)

    The long and short is that they don't seem to have financial details for this account and are no longer replying to messages once I asked about supplying further details.

    What stopped you from calling Orange to check the cancellation had been received or to inform them of the cancellation.

    Have you got proof an email letter or something from phones4u that you could send to Orange/EE to fix it?

  • First mobile contract I'd had and had never missed payments, had a reasonably decent service from Orange and phones4u so I had assumed that my request for the contract to terminate after the 24 months had lapsed would have been sufficient. Suffice to say I did not hear from Orange for 7 months.

    Besides that, this is going off track.
