Evening All,
I have received a final reminder from Gladstones solicitors
In the letter it states they are going to proceed with a CCJ if they get no response
I took the “toilet paper” approach to all mail from PCP
Clearly that isn’t the right approach now, and I’m beginning to understand after more research to take action.
Do you think I should just pay it or fight it? I have roughly 2 days left
The amount is £160 currently and will increase to over £200 with court fees etc

It will not be over £200 even if you lost at a small claims hearing. More like £160 so you may as well fight it which is what we encourage. We've never lost a Gladstones case defended on this forum.
They cannot just 'proceed with a CCJ'! A CCJ only happens if a person ignores court paperwork, or loses then refuses to pay what a Judge says! You mean 'proceed with court papers' = so what, bring it on...get it over and done with and seen off!
Search the forum for 'Gladstones LBCCC' if this is a Letter before Claim.
If it is merely a letter telling you to pay a debt collector, then it isn't a LBCCC. So, which is it?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Gladstones are well overdue colonic irrigation
They cannot proceed with a CCJ ?????

Thanks for the info (it made me smile), unfortunately I can't attach the paperwork.
It basically states
"We have contacted you before and due to absence of payment or a valid appeal against the charge we are instructed to recover the total amount due to our client as show above
Because we've had no response we may now be instructed to issue legal proceedings against you in a county court. to prevent such action we invite you to make payment immediately or contact us"
Then it goes on to talk about the feeds going up to 202.25 with court feeds etc.
So are we saying I wait for court papers and then act?

Why did you get a ticket/parking charge in the first place?
And where was it?
Depending upon the answer to the above it may be possible to get a landowner cancellation, or even pursue the parking company/landowner/management company/who ever took on the parking company for a data protection act breach.From the Plain Language Commission:

The client is "Parkshield Collection Ltd t/a PCP"
I believe the ticket is from a venue near my house, its just a activity centre who use a parking private firm.
I parked there for 15 minutes at night and they managed to ticket me in that window.
Without knowing for sure the landowner It might be a struggle to go down that route?

OK so respond asking for all details (a copy of the signage and all photos of this car at whatever location and a copy of the PCN/Notice to Keeper) as you are the registered keeper and have no paperwork regarding this matter.
Tell them not to raise the dispute to a claim without providing you with this information first, in the interests of the 'overriding objective' of ensuring disputes are discussed and information provided about contracts, outside of the court process.
Say no more than that - NOTHING about who might have been driving or what might have arrived and been binned.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have received a final reminder relating to reference 101839.414 which is why I am making contact.
I require a copy of the signage and all photos of this car at whatever location and a copy of the PCN/Notice to Keeper as I am the registered keeper and have no paperwork regarding this matter.
