As he is below you, I can only suggest you take up tap dancing or perhaps the trumpet?

If he is smoking illegal stuff, call the police.

If they deem the noise to be acceptable during the day, then you will have to prove otherwise. DB meter? Recordings?

The police rarely act in these circumstances. Local policy varies, but often it's targeted to dealers rather than users

  • Thank you all for your replies. As I said in my original post, I tried to summarise as much as I could. I was really interested to learn where we stand, legally, as this is not an easy one.
  • We had this issue years ago with neighbours. Our houses were private and both mid terraces. The neighbours would play music from dusk til dawn and no matter which room of the house we went in, we could hear it. We could never use the garden in the summer as they'd be out every summer shouting, getting drunk, smoking and playing music. One day we asked them if they would keep the noise down as we were having friends over for a BBQ. They did do, for half an hour and then turned it up again. We approached them and their response was "we gave you half an hour!" They also told us that if we didn't like noise we shouldn't have moved to a terrace. Our answer was that if they were inconsiderate neighbours they shouldn't have moved to a terrace. Touche.

Like the others have said, it depends what is in his lease and whether he is breaking any of his contractual obligations. You could complain about his drug use.

Unfortunately once you hear the music, it's very hard to 'unhear' it and it really can affect your way of life. It's all very well others telling you to move but that's just not possible at times and it's unfair that considerate neighbours should have to put up with inconsiderate neighbours. But say he did move out and you got someone even worse moving in?

You have my sympathies but I fear the others, no matter how blunt they may have been, are right. I would either plug in headphones or find somewhere else to work. If working from home is an option, then I guess it's up to you as to whether you to go the office or not? I'd spend more time in the office to be honest. You never get any peace if you try and work from home during the day in such close proximity to other neighbours.
  • I'm in the process of selling my 1st floor flat...one of four flats in a small two up/down block. I bought it 4 years ago...and realised once I moved in that the flat below was rented through HA by a young mum...who blasted music all day. After a number of complaints to her and the HA...she was rehoused...I'm not sure whether because of the complaints or not...but I was reaching the end of my tether after just 6 months in my flat. My neighbour in the downstairs flat the other side has just sold up due to the HA putting a rather unruly family in above...they couldn't take much more and sold up. So from experience...even if this guy moves on...you could be dealing with a lot worse in the future and I know where others are coming from when they say you just pick up on the bass rumble. All this will eventually have an effect on work and your health. Honestly if I was you...I'd move ...sounds drastic...but no amount of bartering will solve this.
  • I'll add to my previous post. I've worked in many recording studios...so know how sound travels. If you're above ...sound comes through the floor...if you're below...again the sound travels through your ceiling...either way your knackered. However if you're in a detached house for example..if next door is playing loud music and its seeping into a particular room say your lounge through the party wall....you cross the hallway into the room opposite you could probably not hear the music and its all down to the walls and the amount of air in between the walls which act as sound proofing.
