PCN Soccerdome Wigan - Appealing as named driver

Hi all,

The keeper of a vehicle which i was driving has named me as the driver after receive a PCN from ParkingEye. After reading through the newbies and other forum threads it seems i have lost the use of the POFA 2012 appeal, but i could use a couple of the other appeal points (contracts, signage etc).

I have found a coupe of threads where people had posted photos of the signage on the above mentioned car park, it seems that the signs have now changed slightly to incorporate more info (tariffs etc).

The offence was 4 months ago, but i have only just received the PCN due to only being named as driver recently, i have no evidence of the signage at that point in time.

My main question is basically; is it worth appealing, i still have the option to pay £60, and i can't seem to find any winning POPLA appeals where the named driver has won.

Apologies if i've missed anything out, or included anything i shouldn't have.

    The person who named you as a driver did you a serious disfavour. I hope you have told them of this and tell them never to do I again. All they had to do was hand you the PCN and you could have appealed as the day to day keeper.

    Yes it is worth appealing. There are a number of template appeal points in post 3 of the NEWBIES thread, so that should be your starting point.

    Of course it is worth appealing, they have so many hurdles to jump before they can get a penny.


    Have they mentioned Beavis? if so read about it.
    You never know how far you can go until you go too far.
  • Basically they ignored the letters until they received an LBCCC and then named me as the driver.

    I went to both the Soccerdome and DW Fitness and despite all my appeals they have told me to contact ParkingEye. The only thing the Soccerdome said they can do is that the will confirm that i was using the facilities at the time.

    I have played at the Soccerdome for around 6 years, i guess i was just that used to not being charged for parking i didn't notice when the signs went up!
  • The letter i received has no mention of the Beavis case, although i am aware of it (from the forum posts).

    If you have received the PCN and nothing else, then you need to appeal using the BPA template in blue you will find in the Sticky thread for NEWBIES. However you will need to remove the bit about being the keeper and not naming the driver.

    Copy and paste, edit and send. That gets the ball rolling and will then give you time to read up on how to beat these scammers with a second stage appeal.

    Search the forum for Soccerdome as I recall we have other threads about this place, the signage being woeful. That does at least make it potentially winnable at POPLA.

    I'm sure we had a POPLA decision a month or so ago about this signage being unclear.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
