these pcn,s have an "early bird" discount applied, so it was always £100 , but discounted to £60 for early payment

no prompt payment = it reverts back to the actual "price" of £100 which "should" have been on the signage that formed the contract (if one was formed)

Ah, we've seen BW Legal & Excel make that mistake before. Makes their threat/claim even easier to knock down, blow by blow.

Cant believe I hadn't picked that up before...wood and trees spring to mind !

Just working on my WS...I realise there is a bit of time to go at, but want to have something reasonably coherent early doors.

due dligence and BW LEGAL dont go together in the same sentence

they probably have templates that state the £100 theoretical maximum under the old BPA CoP and so issue incorrect paperwork all the time , just like WH and Gladstones

attention to detail is not their forte , whereas one person working on their own defence will eventually suss these things out

more grist for the mill though , pick holes in anything and everything , make the judge realise what morons they are

Also, if the NTK said £60 then the signs they are going to have to cough up pics of, can only show £60 too. Anything different cannot be the true signs from the parking event date.

So, we are saying that CAVENDISH RETAIL PARK in early 2012 must have had signs and certainly had NTKs showing £60. That may help others...

I have hard copy photos of signs they sent from around that time, I can see the new Sports Direct Building being constructed in the background. I think it was opened in Feb 2014, so I reckon the photo possibly a year before. The P&D Machine looks to have a BPA Motif on it, which would probably tie in date wise. The machine on their photo from 2012ish definitely indicates £100.00 charge and discounted to £40.00. I am not sure how to raise this in my WS, I have put it in there but you guys may know if it needs to be a lot more prominent.

Had another go at my WS, again I welcome your comments and assistance on this.
