    There's nothing that we can do other than plod on. I've seen suggestions of complaints to the SRA but I honestly wouldn't waste my breath on a complaint, it won't go anywhere.


    With respect, I disagree. If the SRA receive say hundreds of complaints against E v L they will, I am sure, act. If we do not bother, the won't.
    You never know how far you can go until you go too far.

    Yes, complaints to the SRA must continue but now, copies to be sent
    to Trading Standards and the local MP
  • I made a complaint to the SRA once on behalf of a client. I put hours into it. It was a genuine complaint (nothing to do with PPCs) against former solicitors. We were never allowed to know the outcome. Data Protection don't you know.

  • I think my concern is that for every case where AJH/EvL is rubbished, there is a case where a judge accepts the argument, so all BW has to do is say that a) these cases are persuasive only and they disagree with the findings but have not been minded to appeal because it is not cost effective (although there was of course the Smith appeal a couple of weeks ago, but was that the keeper's appeal not the PPC's?), and b) there are an equal number of other cases where AJH/EvL is not rejected. So I just can't see how complaints will get anywhere.

    I think Skipton in particular is now pretty much a graveyard for any claimant, we had very little input yesterday other than confirming neither of us were driving on the day of the contravention. If you can remember, Judge Skalskyj-Reynolds requested the Claimant give her more Particulars of their claim. She never responded to their "late" reply...surely at that stage she should shoot down EL v Loakes CPS v AJH Films and strike out the claim, instead of waiting until we all sat in front of her..thats probably to simple!

    I have said for a long time that the courts are fully aware and there must be a system within that alerts them.

    As far as attending the hearing, I guess they must be seen to do something. However, whilst it does waste the time of the defendant, it also wastes the time of the claimant and costs the claimant money

    What is difficult to understand is why the PPC such as Excel use BWLegal as it's fast becoming pointless

    Sounds like the rep from BW was the same as I had today Ms. Devenster Macklow or something similar. She didn't look like she could be bothered to be there and has obviously done this a hundred times before as had the judge.

    The Judge did most of the defending for me too and basically asked if the Claimant could prove the driver. When she said no - the claim was dismissed. The judge knew exactly what the situation was re AJH and EvL and just wanted to hear me say the right things about them being a criminal case and an Employer/Employee situation.

    It must be so tedious for the judges!
