    Did anybody else notice that the "Penalty Notice Reminder" failed to include any mention of POPLA or any appeal process.

    thats because its NOT a parking charge , its a nice letter asking you to pay them £100 or they will tell the nasty men at the train company you parked , and those nasty men might take you to magistrates court .

    there are several flaws in what the intend to do , main one , that they cannot hand your info to the train co

    Whether the TOC would prosecute for parking without a poorly marked bay is another matter, especially if the motorist paid the correct amount to park. .

    Because they are scamming cockroaches. There is nothing in it for most PPCs who take people to court, win or lose, they are usually out of pocket, yet they do it time after time after time.
    You never know how far you can go until you go too far.
  • I think a well timed appeal , followed by a nicely timed POPLa appeal , and the delays involved , + the required 28 days req to pay will kill a 6 mth timeout

    and remember POPLa , back earlier this year , as late as december BPA said "talks were ongoing" , regarding the ability to adjudicate on offences on bylaw land , earlier this mth POPLa took it on their own heads to "fudge over" that question , and state they now have the athority to decide if a bylaw has been broken ,,,,,,,,, not to adjudicate on if the person is guilty or not ! , in 90% of cases "ticket not displayed" the answer will be that the accused has NOT broken a bylaw

    A happy update to report. Following the advice from @twhitehousescat to complain to the DVLA I've had this response cancelling the ticket from them.

    Thank you for your recent correspondence.
    Regulation 27 of Road Vehicles (Registration and Licensing) Regulations 2002 allows vehicle keeper details to be disclosed to third parties who can demonstrate that they have a reasonable cause to receive it. This Regulation provides a legal gateway for the release of information and is not based on the consent of the data subject.
    CP Plus Limited manages the site in question on behalf of South West Trains Limited. The site operates under Railway Byelaws and Penalty Notices are issued where there has been a breach of the conditions and for which you may be prosecuted. The Penalty Notices are not reliant on Schedule 4 of the Protection of Freedoms Act.
    I have concluded my investigation and the Penalty Notice was issued for not parking in a designated parking space in contravention of the terms on the signs. However, CP Plus Limited has confirmed that the Penalty Notice has been cancelled and that you have been informed of this.
    I have enclosed a copy of the cancellation letter.
