Not so with our council (Leeds) our tenants notice period ended on 28th May last year, and they found another property that the tenancy started 2nd April. We were billed for April & May and there was nothing we could do about it because our tenants had told them they moved out on 4th April when they didn't. It didn't matter that we had the written notice from the tenants giving the 28th May as the end of tenancy, I argued the point but the council wouldn't budge.

Unfortunately it can be difficult when there are conflicting stories.

Need to look at whether Leeds CC v Broadley applies (bearing in mind this just confirmed the existing law). Apparently they are currently holding cases (which is very naughty of them) where this might apply though as they are appealing to the Supreme Court http://lgfa92.co.uk/liability-tenants-vacation-court-appeal-hearing/

The determination comes under how council tax legislation decides liability rather than only on any agreement with the landlord over surrender dates etc.

I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

She was verbally abusive on the phone call where she claimed we owe her money and I'm pretty sure she hasn't paid any income tax on the rent we gave her as she was insistent on it being posted through her letter box.

    Any advice is great.

I would get the HMRC to check out the landlord, its a simple process.

  • Quick update, the landlord has been to the council and has obviously been told she's wrong as she had sent a text saying that she made a mistake. Idiot.

    Thanks for the replies.
