Due to failed banking payments I have missed amonths worth or payments and they are now evicting me on those grounds. HELP! What can I do to prevent this - if anything. They are demanding full repayment to incur any hope of keeping my home for me and my son, but with no promises. What rights do I have ?
Any advise appreciated
You say you are in rent arrears for a council property therefore the action the court can take will depend on how long you have lived there. IT IS VERY DIFFERENT TO the process for SOMEONE WHO HAS A PRIVATE RENTED PROPERTY>
if your local authority operates a introductory tenancy scheme and this is still in force the court will have no option but to grant a possession order
If the local authority does not operate this scheme or if youhave held the tenancy for over 12 months you will be a secure tenant which means that the l/a would have to prove rent arrears and also that it would be reasonable to evict you.
You can make an offer of repayment to the court and irrespective of whether it is a hearing for a possession order or a bailiffs warrant the court will have the discretion to postpone possession and allow you to clear the arrears. especialy in the cases where there are children in the house. you weill need to explain to the judge why the arrears arose and what you can do to ensure you do not miss any more payments.
contact your local shelter who can represent you at court if you are aligible or advise you fully having had all the necessary details from you.
Hope this helps

The 2 most important things in life. Food and Shelter. ALWAYS pay your rent before any other outlays.
Just thought I mention it for future reference.
Good luck.
The worlds biggest scam.
You must always pay your {payments to the previous generation for the right to live} before any other outlays.Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0 -

One thing though - if you get into difficulties again, please speak to your council & organisations like Shelter again immediately. The thing the council hate more than anything else is not knowing what's going on, so if you fall behind but can catch up again in a week or so let them know that's your plan. If they don't know what you're doing & just see a computer printout with a missed payment on it, their procedures swing into action & they might activate the possession order, so just keep them informed.

You are really starting to get annoying Squattie. You can interpret the system like that if you want but until you can come up with a better workable system then cut down on the political BS.The worlds biggest scam.

What are your living arrangements anyway? You squatting somewhere and piggybacking your neighbour's wireless broadband?
