Private parking: Ignore or appeal?

I have been issued a second PCN - now a FINAL DEMAND letter, after being parked longer than the period allocated to the vehicle. The contravention time happened in May 2016, and I must have received the first letter a few months later. The first later is now disposed of as I assumed after ignoring it, that would be it. Now, I have just received the second letter, a charge of £125 with 14 days to pay, or "failure to do so will result in this account being sent for further enforecement, in which case court proceedings may begin".

From what I can remember, the sign states that the driver is allowed 15 minutes after the expiry of the ticket, to leave the car park. In this case, I must have left 5 or 10 minutes after the allowance of 15 minutes.

The company is IPC and IAS registered.

What steps should I take from here, ignore, appeal, or ask for evidence? I'm worried if I ignore, I might have a court judgement issued against me, or if I appeal, I am encouraging them to take more action against me.

Where are you ? If Scotland, ignore. If England or Wales, read through the stickies on this board to see how you go about appealing.

The company is Parking Awareness Services, they are IPC and IAS registered.

There is simply no point appealing to the IAS as it's a simple kangaroo court and they back their members such as Parking Awareness Services. It's all a scam to extort money.

Parking Awareness Services ARE BEGGING for money, little you can do but ignore. Probably will be followed up with stupid debt collector letters which you 100% ignore.

Who knows if Parking Awareness Services will take this to court, if they do, come back here

DO NOT CONTACT THEM, NEVER SAY WHO WAS DRIVING and now just sit back

I've read so many threads and opinions, it's very tiresome trying to form a decision!

Yes it is but the most experienced on here is coupon-mad. She will no doubt give you the reply you need and then take notice of her
  • My initial decision was to contact an appeal company who deals with this sort of stuff, such as Private Parking Appeals Ltd, and have them write to them. Or at least ask for photographic evidence etc. Would this be harmful?

You will get the same, if not better advice here for free.

There is nothing stopping you from making a late appeal to the parking scammers by sending the IPC template from the NEWBIES thread. It's either that or ignore unless you get court papers. I would advise appealing late as if it ever did go to court you could show that you were reasonable and tried to resolve the issues early on.

The parking scammers just want your money, and the IPC/IA business model is dreadful and stacked heavily against the motorist. You won't get anything if you ask for their evidence in my opinion. They are most likely to say, you are too late, cough up.

  • Would you best recommend using a template from the 'newbies section' and request evidence etc? Surely if they refuse to give evidence, that would go in my favour as I have a right to obtain the information?

if you ask for evidence they will take it as a request and not an appeal

just follow the tried and tested paths given in the NEWBIES guide, its there as the best font of knowledge you will find anywhere

evidence can be sought later in the appeal system , or even in a court case later on if it comes to it

at the moment you are disputing the speculative invoice , in writing , yes you could ask for evidence but they are under no obligation to provide it , nor will they either , so expect nothing except demands for payment - THEY ONLY WANT YOU MONEY , NOTHING ELSE
