    Good morning all,

I have sent the following list to the property management company this morning to see what they come back with.

    1) Statement from the landowner stating I had permission to park

    2) Statement from the landowner if they felt the ticket was not correctly issued

    3) Statement from the landowner on their advice on what to do if your parking space has been parked in by a non resident

    4) Confirmation that UKPC have full and comprehensive right to ticket my car

    5) Confirmation that UKPC have a full, valid contract with mainstay and the residents of the property to operate a parking charge service

    6) Confirmation on the wording of the contract with UKPC, are they:

    a) Employed to police the correct use of space

    b) Employed to ensure that permit holders have a right to their space (as per the lease agreement)

    c) Mechanism for cancelling tickets on behalf of the landowner

    7) Confirmation that my lease (September 2011) has no mention of penalty for incorrect parking

    8) Confirmation that they had the property managements full consent to erect parking signs in the car park

    9) Confirmation that the exact wording of their signs was agreed with Mainstay when the contract was signed, In particular, their signage states 'No Unauthorised Parking' - Definition is required on who Authorises the parking

    10) Confirmation that all leaseholders of the property were consulted in the implementation of the parking scheme and the specific clause in the lease (dated from September 2011 when I took residence) that there was a mechanism in place to implement a parking patrol company on the property (page number, clause number)

Don't forget the POPLA appeal though.
I can't use the POPLA appeals process as I am arguing mitigating circumstances,
You can and should do POPLA - but as already advised, using our templates (usual arguments, not mitigation) plus include a copy of your lease as evidence of primacy of contract. Your lease would have had to have been formally 'varied' with your consent. Not just a letter since 2011 saying ''we are letting a notorious ex-clamper firm loose among your cars - here are some permits we are foisting upon you all - and you must suddenly abide by extra rules that are not within your contract and we are not going to tell you about the parking charge of £100, you can find that out when you contravene!''.

If you have time, wait to get your reply from the MA, diarise that your POPLA code will work only for about 30 days. Don't wait beyond that.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

UKPC are now asking people to send them a copy of their lease. Tell them there will be an "administration charge" of £10 for this.

... stating that the information contained therein will only be sent on condition that it cannot be used for financial gain or recovery of any perceived parking charge.

Alternatively, send a heavily redacted copy of the agreement such that it is rendered useless for them.

Not certain why anyone should send a scammer a copy of anything

Either UKPC know what they are doing or they don't

It seems the latter is the case

I doubt UKPC would pay, but the idea is to show a judge you were being reasonable and offered the scammers a copy but asked for a small fee to cover your time and effort.

You would of course redact anything useful from it anyway.

Of course you should use popla. Even if they denied you appeal, you would be likely to win in court, another nail in their coffin.
You never know how far you can go until you go too far.
  • Hi Jeff39,
How did you get on? Is this Magdala Court by any chance? I am having an issue too, and so are quite a few of us it seems!
