BW Legal Chasing for a debt that doesn't belong to me.

I received a letter today for a debt that doesn't belong to me. BW Legal have contacted me informing me I owe £349.40 for a payday loan. One I've never taken out a payday loan before and two I've not had a payday for the last 8yrs. I'm a business owner and I don't have paydays, if I need money I just access the business account. I called them and they were not helpful in the slightest, I asked for them to send me proof of the supposed debt and according to them the letter they sent me is proof and that if I do not pay they will issue a ccj. They kept asking for my personal details which I refused to give as they don't need to know anything about me and then I tried contacting the complaint department (who were very rude) and again asked for proof of my supposed payday loan with information of who I supposedly worked for and when etc, they didn't give me any information and I was cut off from the call as they stated again if I don't intend to pay they will issue a ccj and send a debt collector round to collect the debt and that they couldn't help me further. I get the impression if I talk to a wall I will have a better conversation than calling these people again. I've only lived in this property for 10months so I think someone who formerly lived here took out a loan and now somehow they have transferred it to my name. How do I get information out of these people and explain to them that I've never taken out a payday loan before so they have the wrong person and to stop chasing me for this debt?

    Never, ever ring a debt collector.

    It seldom bears fruit.

    Was the letter in your name ?

    Send them the provit letter first off, see what they come back to you with :

  • Yes it is in my name, I'm on the electoral roll at this address so I'm guessing thats how they got my name? Really not sure how they got my details. Thanks for the link I will get a copy of that sorted and sent to them, should I be sending out the letter recorded delivery? All the address details go to a PO Box address so I'm not quite sure how that works.

    You may want to check your credit files to see if any of these gits have registered a debt against you with a pesky default. Make sure you check all 3 as they have a tendency to not have exactly the same info...

  • Hiya I posted a while ago and I'm still having a nightmare of a time with this company. I kept getting harassing letters, going to take you to court etc even though I sent them three letters all of which were ignored until I sent another signed for and then oh suddenly a response. I sent a prove it letter and asked them to stop harassing me etc.
    I now have a new letter that arrived today that states theyve put the issue on hold whilst they talk to the company and have sent me supposed proof that the debt is mine. I tried explaining that its impossible for someone in my financial situation to even take out a payday loan as I would be automatically rejected (been self employed the last 10yrs so I don't have paydays).
    The only information this letter has is a small spreadsheet with information of a breakdown of the money owed. It doesn't actually give me any information about myself/where the debt was meant to have come from. I'm not sure what to send back to them other than well its not mine and you still haven't given me proof of this debt.

    Write back telling them they have not provided a valid credit agreement or any other proof that the debt exists, and that you continue to dispute it.

    If they persist then the financial ombudsman would be the next step.
