If the claim is in '£1,000s' it won't be going any higher at the small claims court.

You should respond to the LBCCC (who is it from?) and dispute the charge. If it's not disputed it can only be deemed 'accepted'.

Have you read the thread linked from the NEWBIES FAQ sticky under sub section headed 'Small Claim?' in bold red text?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Britannia were banned from getting Keeper details for almost two years so they could not have met the requirements of Keeper Liability. They (or is it Gladstones) will simply say balance of probabilities.

You can help Britannia win, by printing all over an open forum that you were driving. Britannia would have no need to reply on Keeper Liability and can print this thread out instead.

  • Yes and I realise it says to respond, and if I do I will use one of the templates from Gan. The sheer size of this cost and the fact that unlike most other posts where there is a reasonable dispute, 10p short / permit in the wrong car etc... I was knowingly making a bad decision
  • So I should delte this thread and re-write?
  • I can't find how to delete, only edit out bits of text

To delete a post, you have to use the advanced edit option, but I don't think you can delete the starting post of a thread.

The best thing is to replace the text with, "Editing in progress" to get rid of it quick, then start again and edit your modified post.

Deep the OP's first post gave too much away. Instead of the OP making a full edit and re-typing the text it was deleted.

So far no new thread so who knows

The OP should contact the DVLA and ask who requested the Keeper details and when. They should then check the dates of the charges against the DVLA list to see if Keeper liability is applicable to any of the tickets and work from there.

If Britannia have used the V888 paper application, ask for copies of these too.

An early Subject Access Request would be useful but don't miss the deadlines for Acknowledging any claim and sending in a defence if this ends up with a claim.
