South West Trains Car Park DRP LTD

Hello People of MSE,

I am looking for advice on pcns specific to railway car park's, specifically South West trains if possible.

The "offence" occurred around mid October 2016. And the creditor is CP Plus Ltd.

I have ignored all the letter's etc and now I have the good old DRP telling me I need to pay £120 or they will clamp my car quoting section 219 of the transport act 2000 as I was parked on railway land. Take me to court etc etc...

Now I was commuting from this particular station into London for about 3 months and I forgot to pay one day and I receive a ticket which was £60. Now that's massively disproportionate to the original £3:50 parking charge. Is it worth contacting SWT directly and explaining this to them, maybe plead with them ? Or is that fruitless ?

How would you advise I proceed ? Do I wait, pay, appeal etc..

    The Sticky thread for NEWBIES is near the top of the page where you started this thread. You are advised to read it before starting a new thread.

    You have limited your options because now you are too late to appeal to the parking company. Ignoring has not been advised here since the law changed in 2012.

    However, this sounds like a byelaws ticket which can only be for trespass, not for failing to buy a ticket. DRP are lying if they have said they can take you to court or clamp your car. They can't
    If it is covered by byelaws then it times out after six months and becomes statute barred.

    Contacting the train operating company probably won't get you anywhere other than admitting to them that you trespassed.

    I would suggest you ignore everything now unless you get either a LBCCC from the parking scammers or a summons to the magistrate's court from the train operating company or their landholder agent.

    as above , ignore DRP and let this time out under the byelaws (so the TOC have no case to bring)

    ignore CP PLUS for up to 6 years unless you get an LBC or an MCOL

    no need for links, just go to the top of this forum and the NEWBIES sticky thread is usually about the third one down

    Just to add, nobody here tries to help for financial gain. We do it because it is the right thing to do. No gifts or financial remuneration are necessary and I suggest you remove your offer before it offends someone or a board guide removes it.

    Whether they can or cannot clamp your car, they have to find it first. Use another car, walk or cycle, or hide it until this times out.

    All Railway car parks are Byelaws so the "creditor" cannot be CP+. Suggest you query the DVLA on this one as it appears though they may have had reasonable cause to have your personal information on behalf of SWT, they don't have it for themselves.
