Hi all,
My brothers received a parking fine from parking UK management about 7 months ago. Every now and then they would receive a few letters. The original fine was £40 and now its over £200. We have now received a letter saying they have made a claim and are taking us to a small claims court, which is very worrying. Not sure what we should do, there is an option to go through a meditation route where you can settle it out of court. However we would reluctantly pay the £40 but do not want to pay the £200 plus fine they are now saying it is. Any help would be appreciated as this is causing a lot of stress to my family. Thanks

What exactly have you been sent? Real court papers from Northampton County Court?
Has your brother acknowledged service of the court papers? He (with you, if you're going to do most of the work on this) must do that as a priority, but please read and understand the section in post 1 of the NEWBIES FAQ sticky headed Small Claim? very carefully as this is the best advice you can get.
Your brother will have to attend court, you can be there with him, but he must attend.
Have you been in touch with the car park's landowner to tell them of the hugely disproportionate action by their agents (the PPC) and ask them to intervene?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yes they have received papers from northampton county court. I have made them send the forms back. In the meantime I will see if I can contact the landowner, however I'm assuming its too late if it's going to court. I will also read the section on the small claim section. Thanks for your help.0

He was actually parked on a road of a residential estate, there were no double yellow lines and he wasn't obstructing anything. However I believe there were residential parking spaces.0

What has he got, that is what did he get in the first place, I assume all paperwork had been kept.
Why did he get a ticket and why: over stay? Residential space? what?From the Plain Language Commission:

There were spaces and there was a sign saying park in the bays. They assumed this was for residents only so parked on the road. They would of been parked there all day as they are carpenters and were working on building new flats. I doubt they have all the paperwork but will check.0
