Mortgage ppi / ppi cover help

I recently tried to claim back my mortgage ppi which in short went to the ombudsman and they favoured on the side of Halifax.
My question is if my claim wasn't upheld how do I claim against the policy when I was unemployed? This was back in 2003-2005 at the time I was told I wasn't eligible to make a claim but I am now told I wasn't miss sold the policy so surly they cannot have it both ways?

Please Help

Your claim doesn't appear to have been eligible.

    You weren't mis sold.

    The two statements aren't contradictory.
  • But if I wasn't miss sold the policy then surely I should be entitled to make a claim?
It was a mortgage ppi so everything would have been gone through in great detail and the policy was entended to cover me for lost of work

That is quite normal. Most MPPI complaints are rejected.

It is probably better not to mix the words up. You complained about the MPPI sale to Halifax and then to the FOS. Claim is what you do when you suffer claimable event, like being made redundant.

Why were you not eligible? There can be plenty of reasons which mean you are not eligible but not mis-sold. For example, change of employer but still within probation period. Or within 6 months of starting the policy (that period is different with each provider). Or being sacked rather than redundant or the redundancy being voluntary rather than forced.
But if I wasn't miss sold the policy then surely I should be entitled to make a claim?

It would help to know the reason the claim was rejected. And perhaps what the FOS said when you raised this point to them?

We don't know the policy terms or why ithe claim was declined. Any claim still needs to meet the criteria.

Did claiming after edudnancy only pay out after a certain time? Like after your garden leave finished for example?
