ANPR No Response to Appeal

Hi,
I've appealed a ticket from ANPR (member of BPA) on what I think are good grounds. They have received this appeal twice, both within 28 days.
They have failed to respond to either appeal and have now got DRP (Debt Recovery) sending us letters, which we have ignored.
Should we just carry on ignoring now?
And by not responding to appeals are they breaking their own code of conduct and BPA's?
Have searched but can't find an answer.
Thanks

send email tp BPA stating dates and lack of POPLa code , let them sort it0

yes and its been answered before (not just about ANPR but other PPC,s as well)
send copies of ALL PAPERWORK (unredacted) including the NTK and your appeals AND the DRP letters , to the BPA AOS compliance team at the BPA (email aos @ british parking etc) , let them investigate this breach of their BPA CoP , especially the lack of a POPLA code by return (they had 35 days to acknowledge and comply or cancel)
this is all covered in the NEWBIES sticky thread too
if you want examples of what to write , again there are dozens as its been done hundreds of times before in the last few years
and let us know how you get on as the BPA like to fob people off at DRP stage, when in fact it should not be with DRP at all
IGNORE drp completely (just file their garbage for now)0 -
you have ommitted to tell us which ANPR this is , there are 2 of them both BPA members
ANPR PARKING SERVICES LTD
court cases 2015 0 2016 0
ANPR PC LTD
court cases 2015 0 2016 0
there is also ANPR Ltd , but no longer in a ATA
which is the company that you are involved with?0 -
Hi, thanks for the responses.
The parking company is ANPR Parking Control, caught by camera. Appears no court cases so what I'm doing is correct.
I have read threads but couldn't find anything specific regarding company non response to appeals. I assume they haven't responded and are trying the bully boy tactics of DRP as if they turn down appeal I will then go to the BPA/POPLA and they will have to pay a fee!
I've emailed BPA (not formally complaining/appealing) asking if they expected their members to ignore appeals. They didn't appear too concerned!
I was thinking of waiting to see if ANPR threatened court action before going to BPA officially, although there seems to be the suggestion to go to BPA now.
My appeal was based on no contract entered into as awful signage, which was A4 size with very small writing, and location/size of writing of main sign not complying with BPA guides, so basically didn't realise there was parking restrictions. I'm positive they won't win at court, and assume they agree which is why they are ignoring appeals and bullying. My partner would have paid by now, which goes to show bullying works - or causes a domestic ;-)

yes make a formal complaint to the BPA
a: they have failed to give you a rejection
b: they have failed to give you a POPLa code
c: until a rejection is received (and POPLa code) they must stop all further attempts of collecting monies from you
looking at the bmpa website they seem a quiet company , then you go to the POPLa annual report that lists all POPLa cases allowed/lost / total and realise that this company have not issued any POPLa codes in 20160 -
If this is ANPR PC Ltd, then I recently had a similar experience. No reply to my appeal (made through their website) after 35 days. An email to the BPA to complain was quickly answered to confirm that ANPR PC Ltd had cancelled the ticket and the case was closed. Great bit of first-hand advice there from Turnip13. Just follow exactly as they did and hopefully this will see the end of it for you. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
