garage damaged car while in thier car

Car Toyota Avensis 2.2d 2007
My sisters car went in for some work to be done after she slid into a kerb in the snow the garage i took it to said it need a new bottom are and the ball joint that is attached to it and it would be ok so i left wit h them as they said it was too dangerous to drive and they gave me a lift back i have now had a phone call saying that while it was parked up waiting for parts in their yard it had been scratched heavily and gauged on the front left side bumper and they said it would cost an extra £150 on top of the £195 to fix the original fix of the bottom arm and ball joint
they continued on to tell me i had left the car at my own risk and they were no responsible for the damage thus leaving me an extra £150 out of pocket which she can not afford if we have it done
Please tell me if am liable for this or if they are as im sure its their problem as it was in their care not mine

    How was it damaged?
    If they've caused it then I can't see them having a leg to stand on. In which case best bet is to organise the original repair to make it roadworthy then pursue them for repair to bodywork

  • it was damaged while it was parked in their yard while they waited for a part that was sent wrong it was the front bumper left hand side very badly scuffed and gauged out the said as they didnt actually do it but it was done on thier property while they were working on its not their problem
  • got a message swearing at me telling the done me a favor not letting me drive it home when i first took it in and gave me a lift home ,on top of that they said the parts were an extra £50 as they had to get genuine parts but they offered to not charge me for that as it wasn't my fault

    We had this scenario a couple of weeks ago.
    Consensus was if it was a garage employee that damaged it, then the garage is responsible.
    If another customer crashed into it when it was parked. then they are not, as they and their staff were not negligent.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    I would visit and get photos of the damage. You may need to break all ties and have it fixed elsewhere and seek repair costs from small claims.
