Halifax credit card payment dispute

Hello

Newbie in need of help please. I bought a second hand car from a local garage for £7000 which was advertised as 'in showroom condition' and 'in the excellent condition' and with 'full service history'. Turns out the car is none of the above and to top it all I contacted the previous owner and he confirmed that everything that is broke on the car he did and more worryingly the car has had a replacement engine which has low compression in cylinder 4!!!! :mad: not a happy bunny. We took the car back to the dealer to demand a refund under Section 75 and reject the car before 30 days has elapsed. He point blank refused and so as I'd paid on credit card I rang them. They have taken a week to come back and say they need an independent report to assess the claim.

Has anybody had any experience of getting money back for a car? Help me Martin :money: please as I'm scared that I will be left with a debt of £7000 and a useless car.

    Get a report to prove it, also if it does have low compression in cylinder 4 cant the other owner show you the report
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • 1) You don't demand a section 75 refund from the dealer. You just demand a refund.

    2) It's perfectly reasonable for a credit card company to request proof of the problems from an independent report. If your claim is successful costs for the report will be reimbursed.

    3) S75 claims are rarely quick.

    Moving away from the CC issue, wouldn't the highlighted points above have been clearly false before you handed any money over?

    Do you have recourse under the Sale of Goods Act? Alternatively I would be threatening legal action if the dealer refuses to refund - how long did you have the car before you went back to the dealer and why did you pay for it in the first place if it wasn't as advertised? Or did you buy blind from a website?
