    This might be too late but in my case (residential block) both the Freeholder and the managing agent denied entering into a contract with AM Services. They appear to just rock up and trespass on people property and place signs up, they also place these signs along side the public highway pretending that it is private property.

    In my case I have brought this up time and time again with them that they don't have a contract for the land and they deflect making out that the contract is between the driver and them, via the signage. Make sure you don't get sidetracked into muddling which contract is being scrutinized in court.

    I didnt enter into a contract with them, was handed a permit without signing anything for it and without a permit holder to display it in, it was sellotaped to the windscreen where over time the sticky came off and (am assuming) the permit fell off the windscreen into the footwell, they took enough photos to have been able to see it and photographed the car from every angle bar that one as the permit would have been clearly seen.
    As you needed a credit card type thing to even enter the car park the whole thing is a total joke. If I had parked outside of the car park I would totally understand but the car had been parked there for 18 months+ without incident. Thankfully I have moved away from there and their underhand tactics, they should have been protecting my right to park in a bay that I paid huge council tax for not penalising me as a resident.
    I wont be going to court as I can only take time off unpaid and it really isnt worth it.

    You will lose, then, unless they don't turn up (I expect they will). You will then have to pay their full claim, is that worth it?
