BR SOA online vs paper forms at court?

Ive looked at the online forms on the Insolvency website for going BR, a family member recently went BR and had 3 identical SOA forms to complete at court, how many online copies of these forms should someone print off, 1 or 3? (just in case.....)

I was told by my court to bring 3 copies of each
  • Stubies correct. I think one copy for the OR, one for yourself and i'm not sure what happens to the third, but i guess the court.
I wrote all mine out because i had no printer ink (and couldn't afford to buy any)! and i'd heard on a couple of occasions people were half way through there on line forms and the computer crashed/froze etc, and they had to start all over again.
Writing it all out is difficult though. You have to make sure each of the 3 forms matches correctly and its a long process. I'd say it took me a good nine hours to complete, including all the searching for papers, addresses and cross checking etc.

  • think ill prep the online forms, i dont fancy sitting writing it all out 3 times, or do they make you stand? (as your the bad boys?) lol

i shouldnt laugh, but if i didnt id just cry
  • Yes Max, i had flashbacks to my school days when writing it out 3 times...

  • at least i can go BR on the cheap as we are on WFTC.......
  • what exactly are the mechanics of going BR?

fill the forms out and print off, ive got that.

go to the court with any fees, do you get put in the stocks?

does the judge grill you? thumscrews and the spanish inquistion?
  • The mechanics are actually quite easy. As you say, fill in forms, get a court date, save for fee, attend court (no stocks)! the judge will check you've taken advice from the likes of CCCS or CAB etc, no thumbscrews!
Almost Everyone has found that the court clerks and judges are nice and sympathetic. Ditto the OR's.
After the judge has signed, one of several things happen.
    a) you speak to the OR briefly and just confirm a few things or...
    b) you have a full OR interview
if you do a) you then recieve a letter a few days later giving you a date for a telephone interview (though , occasionally face to face)
And thats it. There is the 'going in the local paper' bit to contend with also.
It isn't difficult by any means, but that doesn't mean to say its easy by any account.

Also, i have not heard of anyone being grilled by the judge. Most of them have been 'lovely'

  • if the company who owed me £12000 hadnt gone tits up id not be doing this, how is it a ltd company can fold easily and directors can walk away whilst the little guys get screwed?

    bitter? me?

    bank on it
  • They can and they do and its the likes of you that get screwed. Don;t get mad, get even.
You can and will come through this and you'll be better and stronger and wiser for it.
I'm at the better and stronger stage..am still awaiting the wiser stage..but it will come.
You've already accumulated a lot of knowledge and this has been a learning curve (albeit a steep one)

Yep, I know what you mean...seems very unfair...they just walk away and start again as ********LTD. I've been in your shoes.
