Preowned games - what rights do you have?

Yesterday I bought a preowned / second hand copy of the Xbox game Gears of War from my local Blockbuster video store.

All was well and fine and the game seemed to work fine until half way though I would get the error message along the lines of

"This disc is unreadable. It may be the wrong region for this console. Match the region of the disc to the console. Clean the disc with a soft cloth. Restart the console. For more help, go to www.xbox.com/support."

Tried to clean it (the proper way, not with a t-shirt like some people I know) and still no cigar.

Now I think i've still got the recipt, but with this being a Pre-owned game and working half waythough and no further, it would be tricky for me to prove something is wrong with it.

Does anyone know what options I have? i'll be gutted if I have to go out and buy another copy.

Ask the shop to replace it. Sale of Goods Act still applies to pre owned goods. I.e. not fit for purpose. Some shops/places give their own guarantees as well that the pre owned games are fully working.
