My mum lives in a retirement property.
The lease dictates redecoration is due this year and the management company have said that section 20 comes into effect due to the cost of the redecoration. We thought this just meant that all quotes had to be detailed to residents but the management company have now said that they HAVE to appoint a surveyor to come around and decide what needs doing and then they gather quotes and take a percentage of the cost of the works.
Local contractors can be put forward to the surveyor but we know that they have already supplied quotes so we are unsure why we may still have to pay the local contractor and then another 10-15% on top for the surveyor.
Is it correct that the management company HAVE to appoint a surveyor as all I can find on section 20 suggests that a surveyor can be appointed if the residents request it.

If the management company don't have the relevant skills in-house, then it may well be reasonable for them to instruct a surveyor.
The surveyor should specify what materials should be used, and check that the contractor does a proper job.The surveyor should also make sure that only work that is necessary is done.
If the management co didn't use a surveyor, and the job was then done badly, the leaseholders might sue the management co.
But your mother can challenge the need for a surveyor. Then, if the management co still use one, she can challenge the charge she has to pay at a Tribunal.0 -
We had to pay for a surveyor on my block external decs (don't recall how much)
we still got a crap job
