Counterclaim is a misnomer as each claim is a separate item. They can be heard together or separate.
You can raise a separate claim if you wish by sending a letter before claim letter to MB. In the LBCC you can simply say you will be relying on the outcome of this case to underpin a claim for damages for their misuse of your personal data.
If you time it for a couple of weeks before the hearing then if you win, you can then move onto raising the paperwork and paying the £25. Email MB's version to them (or in fact to their solicitor if they are using one), don't waste printing & postage on them! Copy in yourself to the email and print out the received/sent item (both) to prove it went & was received by recipients. Add that to the file you will take on the day, along with your Schedule of Costs, already pre-calculated.
The court version should be printed out and in a ring-binder or similar file, with page numbers and evidence numbers, and a contents or index page, referencing the evidence/page numbers.
Both the court and the claimant need to also receive your evidence/exhibits you intend to rely upon (the items referenced).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

An update:
Gladstones did not pay court fee so case struck out. I have not had my chance in court to prove my case.
What now?
Do I pursue a Data Protection Act Section 10 notice to get my details removed from their system?
They are now causing me severe stress as every blank letter I receive I get panic attacks over - ".. is it Gladstones starting up again? Is it MB starting their c**p again"
All I want is a letter from MB saying cancelled in this instance - their failure to allow me to defend myself/prove case in court
BTW - SRA say no further action. how ridiculous! Gladstones blatantly failed pre action protocols and abused the system to put undue pressure on me.0 -
