Still waiting to exchange. Can't stand this much longer

As you can see by the time I am posting this I am here again lying awake unable to switch off with the stress of this.

My mum died last year after a long and horrible illness.

We are in the midst of selling our family home.

Found an EA who found a buyer within days. This sale fell through at the last minute. Found another within days again. BTL landlord (the first one was too). The buyer offered a slightly lower price on the proviso it will be exchanged by Christmas as he could buy all the info from the solicitor from the original sale. As were in the midst of a house purchase we were advised to accept the lower offer as a trade off for a quick sale.

Now we are due to exchange. The buyer has signed the contract and shown his proof of deposit to the solicitor but refused to exchange until the property was empty so I arranged that. Every day for the last week he has been saying he is going to transfer his deposit (that's all that's left to do) so my solicitor chases his solicitor and it isn't there. No one can get hold of him until the next day when he promises he will do the same again.

The EA won't give him a nudge as all they keep telling me is he is one of the good guys and I have to trust he will do it. He has bought ten properties from them in the last year so he knows what he is doing. From this I am inferring that he lets his properties through them and so they are playing nicely with him so as not to lose him as a landlord. On the other hand they will think nothing of calling me demanding I do stuff for him and even turning up while the house clearance men are in and shouting at them in the street in front of the buyer.

Tbh I feel like I have been totally taken advantage of at the most vulnerable time in my life by a company out to make a quick buck for their landlord and it makes me feel sick.

I wish I could be more resilient or assertive about this but tbh I'm struggling a lot since my mum died and just want this over with.

    Are you sure that the buyer isn't gearing up to gazunder you? It's a bit rotten taking advantage of someone who's emotionally fragile, but some people are like that.

    You need to make yourself gazunder-proof:

    In the morning, you should pick up the phone to a different estate agent and discuss giving him instructions. Then pick up the phone to your present agent and tell him that you've had enough and you've decided to instruct a different agent. Miraculously, your buyer will perform, most probably.
    No reliance should be placed on the above! Absolutely none, do you hear?

    Stop the sale then. Or threaten to pull out unless exchanged nd completed by a certain date [a very soon date]

    House selling and buying is not for the faint hearted, it's very stressful, on top of a bereavement, it can be much more stressful. You started thsi process because you want a house of your own, so it's up to you, you either keep going or stop.

  • It's never really going to get easier though is it Taff? I'm selling my family home. The last tie I have to my parents. Yes I am also purchasing but I need to sell on a practical level as the costs I am incurring on keeping the house empty are too much.

    Yes it is. My mother died in similar circumstances the year before last, when I also sold my own home, and bought another one. I was a big tearful mess most of the time, but it does get better.
    Selling your house though, the EA works for you not him, so tell the EA he's got one week to give the bloke a nudge or the house is going back on the market.

    You will soon see whether this person can afford to buy your house - if he's bought ten properties in the last year, he may be relying on selling one he's already bought, or the rent from them for the deposit.

  • The EA (randomly) sent me a copy of his statement of accounts from his solicitor, the mortgage money is in there and he has shown proof of deposit so I'm not really sure about the hold up...

    Yep. If there are no fees, it may be time to consider changing agents, too. They have clearly failed you here.

    The EA is working for you or at least should be - because you will be paying the bill - not the buyer. Speak to them again and ask them to re advertise the property. If they refuse tell them of your intention to go elsewhere and ask them to provide a list of all parties that they have 'introduced'. You will need to give this list to any other EA.

    That should be a suitable 'nudge' ... even if you don't go ahead with another agent.
