Private parking charge in Scotland - Parking Eye

Hi all,

I've read the informational sticky, but info for Scotland appears to be a few years old and just want to get my facts straight (and current).

I received a "Parking Charge Notice" for £60 from ParkingEye for (allegedly) overstaying by 1h12mins on a 2hr max stay car park.

Advice seems to indicate that in Scotland, *if* they elected to take me to court, they would have to prove that I was the one who parked the car there. If they were able to do that, then they would only be eligible for losses incurred (which can't be much since it's a free car park, intended for customers of the retail park it serves).

1) Do I write back at all, or just completely ignore?

2) If I ignore, and they send it to a debt collector, is there any way this can appear on my credit report?

3) Advice also seems to suggest complaining to the landlord/retailer, but isn't this an admission of who parked the car?

Thanks.

Everything in the NEWBIES FAQ sticky is current. Check the date of editing on each post, not the date the thread was first created.

    1. Completely ignore.

    2. Ignore even more. Debt collectors have no affect on credit rating.

    3. Depends how you phrase the complaint. So do you say 'I parked', or 'the driver parked'?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I know I like a long lie now and then but please tell us how in the blazes did the 30th of December 2016 become "a few years ago"..?

I saw the date in big text at the top of the sticky, (10th Nov 2013), and missed the date in tiny text at the very bottom of the post (30th Dec 2016).

It was an honest mistake, and frankly - given the formatting - very easily made...

Maybe adding a line to the top of the sticky in larger text just to say "Advice current as of 30th of Dec 2016" would help prevent this kind of thing in the future.

Thanks for the help in any case.

I will add something like ''Advice current for 2017'' when I next edit the thread, which is kept deliberately locked to stop replies. I have to get it opened to edit it but do so regularly and will do so in Feb.
