    Sorry for any confusion. The account was opened in 2010 and I believe I defaulted that year. The default date was marked as 2012 and I paid the balance in 2013 and closed the account.

    I'd like to obtain a statement from them for two reasons:
    1. After communicating with them recently I don't trust Littlewoods to look at my complaint properly / tell me the truth regarding my account so I hoped that obtaining a statement before complaining would help my case.
    2. I'd like to see if there was any form of insurance / PPI on this account.

    Well you can send provit letter first, should you wish too, to obtain the evidence you require, then complain separately about the default date.

  • So, I sent them an email querying the default date and received the following response (shortened):

    'An account would be registered as defaulted after six months of non-payment.

    On checking our records I can confirm that no payments were received on your account between the last order date 10th January 2012 and the default date of 31st July 2012, so the default date recorded for this account would appear to be correct.'

    And then a bit about the account no longer being registered with Sop Direct on the Credit Reference Agencies (Equifax, Callcredit and Experian) and to call their debt collection team with any furtheer queries so that they can liaise with Lowell.

    I've checked my bank account and racked my brains and believe the above to be the case. However, I don't remember receiving a notice letter for the default... Is there anywhere to go from here?

    So, I sent them an email querying the default date and received the following response (shortened):

    Unfortunatly what they have told you is true. If those dates are correct I would say your stuck with the default :(

    Surely I can query whether Littlewoods initially sent me a notice of default? And as Littlewoods then deleted it and Lowell then re-registered it under their own name, should they have sent me a notice before default too?

    Hello, could you not request a subject for access request to little woods with a cheque for £10.

    This would mean they would have to send all the information they hold on you.

    Then you can check out and report back if date is wrong or you can just complain..

    Surely I can query whether Littlewoods initially sent me a notice of default? And as Littlewoods then deleted it and Lowell then re-registered it under their own name, should they have sent me a notice before default too?

    Clutching at straws really but may be worth a go. A default notice is considered served if it was sent to your last known address. Proving if this was sent or not is not easy. The debt collection agency is not required to send you a default notice.

    So, I sent them an email querying the default date and received the following response (shortened):

    Do you agree that you made an order on 10 Jan 2012? If not, ask for details of that order.
