Travel agent has cancelled our holiday and no notification

    Online seat allocation has been available for over 5 weeks now. The seats had been allocated to our group back then, and were safe (so I thought until they were cancelled). So yes, I do agree that sitting together is not guaranteed, but considering they had been allocated all that time ago, I feel justified in potentially upgrading. That may potentially be a small amount in the scheme of things.

    The holiday has been reinstated so all you can claim for is compensation for the stress and disappointment caused to you.

    They have broken the DPA - yes, but that is for the ICO, I'm not sure you have a claim against them for this.

    Concentrate on having a nice holiday and ask them for compensation but you need to be realistic about what you're entitled to.

    Not a good idea. You have got what you paid for. A seat in a certain class from A - B. Seat numbers can be changed at any time, even once you've boarded. They have no reason to pay for your upgrade just because you chose to based on something that didn't form part of the contract. You may find that there are seats together when online check in opens.

    If by upgrade, you mean switching to a so-called preferred seat then it's not going to be too much if you lose out. It's worth noting that often these preferred seats become available for free in the 24 hours before check in.

    If you mean upgrading to another class of service, you will almost certainly have no luck in getting your money back!
  • As it stands, my Wife and I are now at Manchester airport as planned, after everything only finally being confirmed for us at 6.15pm last night!!! The agent had to upgrade us to Comfort + as there were no other seats available, but my brother and wife are not travelling. So a result of sorts, but a fight still to be had on return.

    Glad you got sorted out but what is "fight still to be had on return ",is this with your step brother who should not have contacted the travel agent but comunicated everything thru you?or are you hopeing to get your holiday for free.

    I think he meant Flight on return not fight. Hope he has a good holiday.
  • I don't want my holiday for free, no. I do however want some accountability for the blatant way the agent ignored their own terms and conditions, the way they kept us hanging on right until the last minute before confirming the holiday was still going ahead and the total lack of communication. I don't think anyone would say that this situation is resolved.

    However, I am now in my hotel in Manhattan, am going to have a shower after a long day and go out for dinner while we plan the rest of our trip.
