Long time away from these forums, but a friend of mine has recently received a ticket and asked for my advice. Realising that I am somewhat out of date on these matters I thought I would come here for some advice.
He received a ticket from ANPR Parking Services Ltd for unauthorised parking (elements of "forbidding offer" which I know sometimes wins at court, but I have no idea how it goes at POPLA). The signage was very high up and he didn't see it, especially because it was dark when he parked on site. I have advised him that they are a tiny company who have never done a court and so even if his POPLA appeal fails he should ignore and just let me know if he gets any further correspondence. However, if he can get it cancelled at POPLA now, all the better.
He received a Notice to Keeper (in a family members name, as they are the keeper) within the 14 day required period from Parking Collection Services, a trading style of Debt Recovery Plus Ltd. To avoid that family member having to worry about being taken to court (no matter how unlikely that seems) he identified himself as the driver and put in a 'soft' appeal, which was rejected.
He is now at the POPLA stage and I am wondering what the current strongest arguments are for him to make, both generally and against this specific company.
At the moment I plan to include points on lack of offer, poor sign location and no contract with the landowner.
Any insight will be greatly appreciated.
