    Oh please stop people in your family 'helpfully' doing this; no-one rings BW Legal and that means they have that person's phone number too.

    Are you certain that BW Legal didn't keep that phone number and phone that relative and bother them, and they haven't admitted that to you as they were flustered and now feel bad about it?

  • It was my dear old mother who spoke to VCS not BW Legal. She has assured me that it was a short phone call just stating I was out the country at that was it! I will be sure to send the letter. Thanks very much for all your help. I will post on here if there is any change to the circumstances. Thanks agin!

    No, his Mum phoned BW Legal first time around (bad idea) but I reckon they stored her number and later called back & got the address. A second conversation probably took place but they should never have contacted her again. Doesn't stop them though.

    Maybe someone else answered Mum's phone and 'helpfully' gave the nice legal services caller your temporary address. Would have been recent, maybe over Christmas/New Year when other family were around who might not have thought twice.

  • After sending the recommended letter above. I have now received another letter from BW Legal at my temporary address in England requesting I pay the balance. They have also given me an estimate of £244 if the case is taken to county court proceedings. Based on the PCN occurring in Scotland and my permanent address is in Scotland am I safe to ignore them from here on in?
  • do not reply , they have your home address , someone other than you has given a english address , when no reply they will start on scotland again , even in english court a: they would be knackered as they have not got details from DVLA

    send letter back , summot like "the lodger is no longer working in the area , try 22 smith st glasgow , or wherever you are

    when they write to scotland write back , "sorry dont know who had the car that day

    I think the time has come to report BW Legal to the Information Commissioner for refusing to update their records to show your correct domiciled address, being apparently about to issue a claim to an incorrect English address because they know that in Scotland you are out of jurisdiction and no doubt they hope you might not see any claim form in time, either.

    Do that this week, online - easy to Google and read the DPA principles first and see that BW Legal are in breach, which is what you need to say to the ICO. All done online with a few tick boxes and you need to attach proof that you told them where you live and show the ICO that they have ignored your letter. As such, this is set to cause significant distress to the occupants of the English address, your relatives who will be mortified to see a court claim arrive. This is also causing you serious distress and utterly wasting your time.
