Section 75 or financial ombudsman

I have bought two bridesmaid dresses via an online dress company 'Joanne's Dresses'. They arrived a different shade to what I have ordered and I am having trouble in getting a returns address.

I have today been on the website and it says Error 404 Not found

Should I try a section 75 or financial ombudsman to get my money back?

I paid on my nans credit card.

Any advice appreciated.

    The FOS doesn't get involved in dress purchases - only issues between customers and financial services companies.

    Unfortunately, section 75 doesn't apply where the purchase is a gift for someone else, which is effectively what has happened by your using someone else's card.

    However, your grandmother could try talking to her card company re a section 75 claim - she may get lucky.

    If the payment has been made by somebody who doesn't benefit from the purchase I'd be surprised if a S75 claim succeeds.

    *All our dresses from Joannesdress are tailored by experienced professionals and hand-made accordingly. Each dress goes through quality-inspection four times before being shipped out to minimize such problems from arising.

    *We are sorry that it didn’t work out. If you are not completely satisfied with your purchase, for any reason*, we will offer you a full refund within 7 days of delivery. *Some restrictions apply.

    *Carefully read our return policy and make sure that all criteria are met before mailing any items back to us. This return policy is applicable to all items in our site except those specially marked.

    *Please do not return items without consulting with our customer service. They are going to initiate the return process with you.

    *Upon receiving your return, the item will be reviewed by our Quality Assurance department. Please note that items showing signs of wear, altered, resized, or damaged in any way cannot be accepted for return.

    *Any unauthorized, improperly packaged, or non-insured packages will be returned to sender

    Return Process

    01. We do not process returns unconditionally. We understand the frustration if it doesn’t work out. We will do our best to process your return and refund as fast as possible.

    02. A return request won’t be accepted if it was initiated later than 7 days of delivery.

    03. When you initiate a return process. Please be very descriptive and attach profound images of the dress and its flaws, to ensure that we understand the problem and we can finish your return request as soon as possible. Please note that manipulated or otherwise altered images do not count as profound evidence, as well as images made in poor

    Order Cancellation

    We understand that it is a very important undertaking to order a dress for your special occasion, and our cancellation policy was created with bearing this in mind. However, it is important to note that our dresses are made to order, and once the tailoring process has begun the materials cannot be reused. The good news is that after placing your order, there is still time for you to change your mind. For further details, please refer to our cancellation policy below.

    1. Unpaid orders will be canceled automatically after 3 days. We receive hundreds of test orders each day which our members are using to quote certain cart contents and save the invoice for later reference.

    2. Orders canceled within 24 hours of payment confirmation will be eligible for a full refund.

    3. Orders canceled 24 to 48 hours after payment confirmation will be eligible for a partial refund consisting of the full shipping cost and 80% of the product purchase price, in order to cover the material cost.

    4. Orders canceled 48 to 72 hours after payment confirmation will be eligible for a partial refund consisting of the full shipping cost and 60% of the product purchase price, in order to cover the material cost and necessary labor cost.

    5. Orders canceled more than 72 hours after payment confirmation will be eligible for a partial refund (50% of the product purchase price at most, the exact refund depends on the cancel time) consisting of the full shipping cost.

    6. Once your order has been shipped, it can no longer be canceled.

    Thanks for this. It won't be classed as gift as my Nan bought and had delivered to her house so I could try getting her to make a section 75 thanks

    But she is not wearing them is she? You are missing the point, section 75 does not cover items for other people unless the cardholder can also use it.

    I disagree with the other's view on s75. If the grandmother purchased the items using her name, delivered to her address and paid with her card then she is the customer and has s75 rights as the breach of contract is with her. s75 would not apply if she is the second holder of the card as the cardholder would not have use of the items. If I buy my dog a £101 dog collar or my wife a £101 watch does it mean I do not have s75 rights ?
