Executors or next of kin

Sadly my dad has passed away this morning, step mother has said to my brother "I suppose you heard the news" and I knew from her callous manner we were in for another of her attempts to manipulate and control things. She has already started to arrange a cremation - Dad's will says he wants to be buried in the family plot with his first wife in the place he had his happiest times.

Who gets the final say if we can't agree, his 3 children, his second wife or the executors of his will? Thanks for any hep, its upsetting enough without any aggro.

    Thanks for that SevenOfNine, executors get to decide, if no will then a list of relatives laid out by law. Executors are Me, my brother and sister. Burial it is then.

    However, you need to get onto the funeral directors quickly, which means you need to get the death certificate. If stepmother gets it then she could arrange something which it could be hard to overturn.

    Note that if she arranges the funeral, she'll have to pay for it and you may not have to refund her from the estate. Don't know if that will help the discussions move along smoothly.

    Well its taken a while, but the funeral is this Friday. Discovered what we suspected for sure today, step mother acting as a power of attorney for my dad has been lying about finances and removing money for his care to her own accounts. Its going to get nasty.
