OP does everything wrong but still wins in Court
I heard nothing further until a couple of days ago, when he sent me this:
"I have the hearing in two days. Could you please let me know if I need to bring any document with me, or the court must have everything I sent already and won’t accept anything else?"
The hearing was listed for today at Manchester at 10:00am (C2GF63Y5 SIP v Mr. T), and at exactly 10:00 he sent me this:
"I can't find the statement I submitted to the court. would you be so kind and forward to me please?"
I was about to file the case in the 'Why Do We Bother' folder, and then an hour later, he sent this:
"Just to let you know the cause has been dismissed as the person who appears representing Sip wasn't an employee of the company, plus they tried to amend the statement on the court. I think this is a good case to show the kind of business they are in."
So it appears that miracles sometimes do happen.
But don't try this at home.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. I don't think you can make any general statement about what the Judges do.
Some Judges in some courts seem to take the view that Beavis makes all parking charges enforceable, and take little or no notice of any defence arguments.
Others are keen to examine the specifics of the case, and will find for defendants if there is any valid reason to do so.
That's why it's known as the small claims lottery - you just have to hope you get the right Judge on the right day.
