Warranty ran out by 1 month

I bought a computer part 2 years ago and 1 month ago, it is now fault and the 2 years warranty is over, paid £340 and just had to replace it for another £400. Store said nothing they can do, but would i have any rights to bring this up with the manfacture with how close it is to the warranty?

Might sound stupid but would be useful for a quick yes/no answer, always worth a try :)

  • You can ask but they don't have to honour it. You could still look to pursue your consumer rights against the trader?

    What's the item? What's the fault?
  • Graphics card, its hard to tell whats wrong other than its showing artifacts (black flashes of lines) while under heavy load and higher temps.

    Cant really argue with the trader, at the time i bought a refurb card of them which didnt work and they give me a new card and told me ill have the 2 year warranty (over the phone), however the contracted agreement with them is the orignal 12 months for the first purchase. They decided when i rang them, they would honor that until the realised it was only 2 years, and not the 3 years every other manufacture seems to offer.
  • Still ive emailed the manufactures and will try and reason with them, just wanted to know if i had any sort of "back up" if they flat out refuse. One thing i have on my side is, they closed the last RMA on the 5th of decemeber and closed on the 15th til the 1st. Could try the old, i try to contact you during closed time as they sent a auto message that the email address is no longer in use since the 1st.

    Your rights with the manufacturer are limited to what they offer .
    Your rights against the vendor under UK law are far more comprehensive . See stickies top of the page .
  • As a consumer you have a right to expect goods to last for a 'reasonable' length of time. What is considered reasonable is of course subjective. If you bought a £12.95 el cheapo non-branded graphics card from eBay, then two years is probably reasonable. However I would argue that you would expect a £340 card to be among the best that money can buy, therefore it lasting only two years (and one month) is not reasonable. First port of call is to the retailer. If as you've suggested they are not being very helpful, put the above point to them in writing and state that unless they repair or replace the card then you will contract an independent expert to prove your point and that you will take the matter to the small claims court where you will not only claim for the cost of the card but also for the cost of the independent report and reasonable associated costs. Send the letter recorded delivery and keep a copy for yourself. Any sane retailer will begrudgingly accept it is quicker and cheaper for them to give in to you rather than face further expense. Second port of call is with the manufacturer using the same argument.

    PS. I know you don't really repair graphics cards, but the law focuses on repair rather than replacement after the warranty expires. It is up to the retailer / manufacturer if they choose to replace instead. Hope that's a help.

    Not quite. The law gives the customer the right to request repair or replacement - with the caveat that the consumer cannot request either of those if it is impossible or disproportionately costly in comparison to the other of those remedies. However in addition to that, it also says that the trader must provide the remedy within reasonable time and without significant inconvenience.

    The law doesn't focus on repair over replace - they're treated completely equally.
