    no earnings were ever declared to hmrc, niether of us have other jobs. she has just started filling in forms for hrmc but nothing while i was there, is it worth pursueing the holiday pay? We have never signed anything to say holidays won't be paid

    Squizz, could I clarify something please?

    What is the basis for your £3.50 payment for walking the children? Was it ever stated to be a pro rata hourly rate or was it a figure just plucked out of the air?
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    You can't sign away holiday rights.

    Just ask for the holiday pay.

    Piece work pay would be a reasonable approach to this sort of job.

    We were just told it was 3.50 per day as the job never took more than half hour

    Aha, all will be revealed. In fact squizz has just said something interesting - the job never took more than half an hour. So if she was being paid for half an hour, then shouldn't she have been paid £3.60, not £3.50, i.e. 50% of NMW.

    But if it only took 20 minutes on more days than it took half an hour, and they were always paid £3.50, I don't think that one would fly.
