  • This County Court Business Centre operation has no interest in consumers and individuals it is just a mamoth debt processing operation.

    Just like everything in this country if its connected to the Governement there is no comeback for the customer. If a private firm operated like governement operations did they would be out of business. NHS, DVLA, Local Council Tax etc how many times do we hear complaints with people bashing their head against a brick wall because of no resolution to their concerns or issues.

    The biggest bugbear I have is people being fined more for not paying a car tax than assaulting someone. World Gone mad.

    I need to finish this up and move one now, start the year fresh!
    I have a solicitors letter with a final amount, and to pay the company directly, with the name to contact as the woman who has been rude and nasty the whole way through, I'm dreading that phone call!
    Is there no way I can pay the solicitors to forward on?
    I also need to pay by credit card, and the letter says to send a cheque, which I don't have :-(

    The plot thickens!

    2 letters received today, one from County Court Northampton for Judgement for claimant £376.85 (dated 6th Jan)
    (£279.85 + costs)

    Another from County Court - Warrant of control (dated 9th Jan)

    £456.10 for not paying the first bill from County Court

    Currently just started started a civil law course - I've checked my law books but they don't give any set time limits for issuing form N323 to start enforcement via a warrant of control after a judgement. I may ask the course advisor as I'm interested in it.

  • I managed to get through to the bailiff, who explained the same, they can pass on the same day, although normally it's a bit longer to give time to pay :-(

    Is there any way to dispute the £70ish as I did send the e-mail as defence/response, it was just never received :-(

    Also he has told me to pay the court direct, not the claimant as I was instructed by solicitors letter.

    If you did not respond then it is correct that a 'forthwith' judgement is issued but that normally requires payment within 28 days and the creditor would not ask for a warrant of control immediately.

    All bailiffs have to pre-notify you now (I think it's 10 days notice of a visit) so they will not 'just turn up'

    Were you trying to defend this or get an instalment order? If the former, you need to apply for set-aside on a N244. If the latter, an N245 will work to suspend the warrant and vary the order.

    From my discussion with the bailiff today, the creditor has issued a warrant of control the same day of judgement, can they do that?

    I have asked my course legal tutor - I'll see what they say.

    I usually deal with Liability Orders from the magistrates court (council tax) - these can be issued to the enforcement agents the same day and although they use separate rules to CCJ's it means the concept is not unheard of.
