MIL Collections -- the first thing to do

In a new tactic MIL Collections claim to have won 7 cases against people being assisted by online users claiming to be experts

You will see a reply from the DVLA regarding the selling of Data

"DVLA will take the opportunity to remind the accredited trade associations for the private parking sector of the need for operators to seek permission from DVLA before transferring DVLA data to third parties in the absence of a sub contract.”


Therefore, if you get a letter from MIL you need to find out if the DVLA gave permission for your data to be transferred to MIL by the parking operator

    Its not unknown for a NoD to be sent to a vicitim which for some inexplicable reason is never sent to the court allowing the PPC a default win when you do not attend or meet filing deadlines.

    I would suggest that MIL are more than just a little bit worried about forum intervention to be putting this sort of guff out. We're obviously having a desired affect. :)

    I have felt no particular desire to respond to MIL's sheer BS until your post BG.

    Firstly, none of the 7 cases identified received any assistance from me nor had they approached me or anyone else in the backroom team (as far as I am aware) for any assistance. It is my view - a reasonably informed one I would venture to suggest - that these cases may have picked up some information from the forums and even basic forms of defences but were almost certainly default wins. From that point of view they are absolutely nothing to crow about and have little value. It would hardly be the first time where a statement emanating from MIL Towers was found to be somewhat "elastic" in its application.

    Sadly, some of the advice on various forums (I will not single any out) is ill-informed and basic defences are occasionally bandied about that are neither relevant in terms of circumstances nor up to date (MIL have changed their proforma Particulars of Claim several times) and are rarely comprehensive. The very nature of MIL's claims is that details are simply never disclosed and in order to cover the bases a defence in-depth is required. Sadly, some of those versions I have seen don't really cut the mustard in this respect but continued to be offered.

    The only approach to a MIL claim is to prepare well and obtaining details from the DVLA is a fundamental aspect of that together with a number of other things. I do not publish a template or flowchart or anything else for people to follow because regardless of the fact that it is a MIL claim the most important thing to remember is that this forms just part of one's defence. You are being asked to defend yourself against the original PCN and the cases are as varied as the issuers of them and the circumstances of the issue. There is no one single approach.

    In some cases it is pointless obtaining a DVLA letter because they were not involved and even in cases where they were the person being sued was not the keeper - especially where hire/lease/company cars were involved. It must remain a "horses for courses" approach.

    If you want to trade statistics I have dealt/assisted with just under 100 MIL cases in the last 18 months of which 18 are currently at various stages of the court process. Of the completed cases just one (1, uno, une, un, eins, adin, jeden, vienas, ek) was won by MIL - technically a default win because the defendant failed to make it to court because of a medical emergency. However, 2 weeks later in a follow-up case (same circumstances) the defendant won hands down.

    The 12 cases that have gone to a hearing (except the above) all resulted in the claims being dismissed and in 9 of those cases costs were also awarded against MIL. In the remainder MIL discontinued every one - usually within the two weeks before the hearing.

    Oh, and I didn't get a Christmas card from Truro :).
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    And I am learning from the 'MIL Master' HO87 and have a few HO87-style bespoke defences in for MIL cases, all of which I expect to be discontinued as long as the OPs come back to me about their Witness Statements/evidence - something I hope I have drummed into them. One person's case I picked up from here turns out to live a mile from me but none of them need a lay rep in court (IMHO most people do not).

    I must use this FOI in defences and the DPA claims that I am going to suggest follow the wins:

    HO87, are you thinking of contacting your back-catalogue of winners (even the default losing person) and suggesting DPA claims in MIL cases?
