Most T&Cs say that a contract is formed when the shop accepts your order and sends the goods to you.
In this case, the seller took payment and sent the goods to you. It sounds very much like a contract was formed to me!
It sounds like the shop should legally speaking send you the plates, or pay you enough to get the same plates elsewhere.
In reality though, is it worth fighting this over a few quid, when you are getting a refund anyway?0 -

When I bought the plates I had no idea of the usual price, the listing said the usual price was £8.99 for 6 and that the sale price was £7.99 for 6, £1.33 per plate.0

It seems to me, from what you have said, that you have a valid complaint.
However I think your best option is to be pragmatic and just accept the refund and move on. To take the matter further you will probably need to take legal action, which in my view is not worth the risk.0 -

unholyangel correctly explains that the contract will be void is there was a "unilateral mistake where one party makes a mistake and other was aware (or should have reasonably been aware) that it was a mistake."
For the contract to be void, the shop would need to prove that that the Op was aware or should have been aware that there was a pricing mistake.
This would apply if it were a TV being sold for £1 rather than £1,000. But personally I can't see it in a case where the Op paid £1.33 per plate plus £4.99 postage, it sounds like a reasonable price to me.0 -
Humans sadly do make mistakes and they have admitted it and given you your money back, I think it unfair for you to hassle the company over a small mistake.
Would you like to be hassled by someone over an honest mistake?
