Hi all. I rec'd a letter from the Court today saying:
"Upon the Courts own motion. The Court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.
IT IS ORDERED THAT
Defence is struck out. Unless the defendant files and serves a fully pleaded by 5 October 2007 the claimant shall be at liberty to enter judgment."
Huh??????? Anyone??????

A general form of order is just that it is used in any case where the rules do not specify a particular form for the order. In this case assuming that you are the claimant and this claim was bought against the bank if the bank does not file a fully pleaded defence by 5 October you can enter judgment against the bank. Obviously the judge did not like the original defence. As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
i did not know that i had 7 days to do anything so is there nothing more i can do ? has the bank won?0
