Just to be really pedantic...
Under UK law you can claim for consequential losses as a result of breach of contract (hence you can claim consequential losses from the CC company under s75).
But the OP's contract is probably governed by Californian Law. They may have different rules about consequential losses as a result of breach of contract.
(You might even be able to claim greater damages for breach of contract under Californian law than you can under UK law. If so, you can claim those greater damages using s75.)0 -

As far as I know it hasn't.
But the OP authorised payment of $500
If a refund does arrive it will be $500
If a profit/loss is made it is made because the OP authorised a payment in a foreign currency.
Exchange rate loss IMO is not a consequential loss.0 -

Well, good news. The company hadn't quite folded yet. So after sending a grumpy email, they have repaid.
This morning they sent out a "we are folding" email. Not bankrupt remarkably! Just giving up trying to make the camera.
If you're interested it's lily.camera . That website is still live and you can see the product update page with history way back for years.
I'm glad I got in before the rush, looks like the rest of the refundees will be waiting months more for their money.0 -

Did you get your refund? I am in the same boat and had an email saying monies have been refunded but it's to a non active card as the one I used ceased early 2016.
Trying to work out where my refund went now0 -

They noticed my card was expired and refunded to PayPal, but they did get me to confirm which account to send it to. They didn't just do it.0

I am still trying to get my money back from them even though i requested the refund before they announced they were winding down. They said they couldn't refund it to my card so they asked for my paypal details which i gave them. Still no refund on either the card or paypal and I have sent them 3 e-mails since with no response.
Can anyone suggest what I can do next?0
