Studio Order

Hi everyone looking for a bit of advice...
Long story short I have never placed an order with Studio before however this morning I ordered a child's dressing gown which I need for Saturday 14/01/17. Based on delivery timescales I was happy enough to chance it and go ahead with the order.
Anyway when I logged on to my account tonight to check my orders it was blank (I received an email acknowledge of my order which quoted an order number). I therefore called Studio and was advised that as I had "applied" for a 'cash account' it was going through the approval stage which can take up to 7 days after which (pending approval) my order would be dispatched.
However I clicked the 'No' for a credit account but it would appear that if you don't open a credit account they push you onto something they refer to as a 'cash account' - 21 days to pay for your order once delivered (didn't want this either to be honest!)
Basically I can't wait 7 days then additional days for delivery so I asked to cancel my order. They told me I can't as its in the approval stage, I insisted I wanted it cancelled however they refused saying they would need to deliver the goods which I could then return (however we are talking about a personalised dressing gown i.e. personalised items once made cant be returned).
However where do I stand with this? I didn't want a 'cash account' I just wanted to pay for my flaming order! And I want to cancel prior to them even personalising the dressing gown and they are trying to say no

By personalised I presume you mean having the name added? If so, these are indeed exempt from the right to cancel.
Unless you & the retailer agreed a time/period for delivery, the retailers only obligation is to deliver the goods within 30 days and you would have no right to cancel unless they failed to meet this period for delivery. You keep using that word. But the issue I am having is the goods haven't even been personalised yet and my account is in the 'approval' stage - didn't want the cash account anyway!
Just checked the email and the technical term is 'Deferred Payment Customers' - do these agreements have a cooling off period?0 -

Are you sure you sure you didn't agree to this form of credit at the outset?0 -
I placed the order using my phone and it wasn't very clear if I am honest.
It is similar to the Next credit accounts that a lot of people are genuinely accidently signing up to because their website is so confusing0 -

The problem is that they are separate from each other. It might entitle you to cancel the credit facilities you unknowingly applied for but it will not allow you to cancel the goods/services - not unless you also have a right of cancellation for those by other means.
https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/422707/bis-10-1053-consumer-credit-directive-guidance.pdf11.1 The borrower has a right to withdraw from a credit agreement without
giving any reason, within 14 days. He must repay the amount of the credit
and any accrued interest. New section 66A of the CCA sets out this new right
and how it is to be exercised24. The right of withdrawal applies to all regulated
consumer credit agreements with the exception of:
• agreements for credit exceeding £60,260,
• agreements secured on land,
• restricted-use credit agreements to finance the purchase of land, and
• agreements for bridging loans in connection with the purchase of land.
11.2 The right of withdrawal under section 66A is a right to withdraw from
the credit agreement only. Its purpose is to provide the borrower with an
opportunity to change his mind if on reflection he feels that the credit
agreement is not right for him. It is not intended to allow the borrower to
return goods or cancel services which the credit agreement has been used to
purchase. The borrower must pay for the goods or services in some other
way (unless there is a separate right of withdrawal from the supply contract). You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
The thing is without the 'cash account' the goods order can't be processed and dispatched by Studio i.e. if my approval was denied (which I know it won't be) the order would be cancelled by studio. The only options available are Credit account or Deferred Payment account.
I have sent them a message about cancelling the 'cash account' that I didn't want/realise I was applying for and in turn therefore cancelling the order.0 -
Hello I have just read your conversation thread and very worried I am in a similar situation! How did you close your account with studio co uk? I cannot find any information on how to close the account with them and feeling sick with worry!
I just signed up to studio.co.uk and chose the deferred payment option though was not too keen to do this but saw it had contact details and high ratings with Feefo, TrustPilot and SSL Secure Global Sign so thought it was legit and placed an order on a rug. I have since found other horrifying reviews on reviews co uk and sent both an email to ask to cancel the order and close the account as well as phoning them asking to cancel the order. They were extremely unhelpful and avoided answering my question the whole entire time and very difficult, just like the reviews said which I had just read.
I guess I have no choice but to wait until the item is delivered and then sending it back and returning it and try to close the account (I read some reviews people had left their account open and then were randomly charged £100-£500 and despite complaining they are still unable to get their money back) and very scared this will happen to me if I do not close the account, but fear when I phone them (once I have returned the item) to close the account that they will not answer my question again and not close the account.
Were you successful in closing your account with them and how did you go about it?
Kind Regards,
Charlotte0
