Civil Enforcement Ltd - letter before action

Hi,

My wife received a PCN from Civil Enforcements Ltd for not registering her car on the touch screen at the doctor's surgery for a scheduled appointment. The surgery has issued my wife with a letter confirming the appointment and asking for this to be taken into account.

Unfortunately the PCN was ignored and now a letter before action has been received just under 3 months from the date of said incident. In their letter before action they've included a draft of their claim and as usual claiming the Beavis claim in their defence.

I am aware this is an attempt at scaremongering but I was wondering if there is anything I should include in my written response to them? I intend attaching the letter from the doctor's surgery. Are there any drafts I could use?

    Trouble is the keeper in your case has thrown away the chance to appeal and get this cancelled at POPLA, as the keeper could have done just by copying our templates. It really was this easy:

    That example POPLA appeal tells you why the DRIVER is not the person to respond, the KEEPER is, because the keeper cannot be held liable by CEL. So by all means attach the letter from the surgery but don't write it as the driver and don't write it as a 'please/thankyou' begging letter.

    You can put 'I am the registered keeper and I was an occupant of the car...' if the name on the GP's letter matches the name of the keeper!

    A robust response telling them the keeper has sussed that they are not liable due to CEL not using the POFA wording, is best. They may well still try a small claim but on this forum, we've never lost one v CEL, when we've assisted a keeper with a decent defence (not a single CEL case in 2016 proceeded to a hearing - they dropped them despite serving court papers).

    Entirely beatable. Just would have been easier at POPLA!

    You don't need to ask for photos and ANPR doesn't pick out faces anyway. Believe us, the DO NOT KNOW who was driving so stop throwing away the very best way for a keeper to defend!

    and delete the post you just made...the keeper is defending this.
