Bank smart trying to charge me!

  • Its very worrying i feel very vunerable...you think your doing the right thing ..had i known all of this i wouldnt have got involved ..the company needs investigating ..

    Then as stated you complain to the company in the first instance, if you remain unhappy after their final response you can take your complaint to the FOS... however in Tracey G’s case it seems you may be worrying before there has been any issue, in which case you currently have nothing to complain about I’m afraid

    Bank Smart were assigned a job lot of claims from Franklyn Hughes Ltd T/A Ascend Finance which they are now applying their own questionable 'breach of contract' terms & conditions to which they shouldn't do - they should honour the original Ascend terms.

    Additionally these claims were assigned on 25 April 2019 and after Ascend finance had ceased to hold a CMC license when regulation transferred to FCA a few weeks earlier. As the assignment of CMC contracts is in itself a regulated activity, the assignments are in fact illegal. This is my view based on a legal opinion.

    I would simply ignore the emails but you could always make a formal complaint based on the above.

    They were originally under formal investigation by the previous regulator but the outcome was never published. The current regulator (FCA) is looking at them.

    You should make a formal complaint to them, that way if they reject it you can then go to the Claims Management Ombudsman. In my experience most complaints are upheld by Bank Smart in the first instance.
  • Hi folks, i received an email from this company bank smart it said i had registered claims with them, ive never heard of them, wasnt sure if the email was a scam so i looked to see what you guys thought, seems they are a bunch of scammers, thanks for the info.. just gona delete it... ;)

    I certainly wouldn’t just ignore it, whilst people may not like their practices that doesn’t mean that what they are doing isn’t perfectly legal.

    Although may not have signed up with BankSmart there is a chance they purchased your claim off of another provider who is no longer able to continue, ask them to supply you with a copy of your contract and take it from there.... but please don’t simply ignore.

    As above, deleting and ignoring may not be the best course of action. CMCs don’t do much but what they specialise in is chasing for monies they deem to be owed.

    I need some help!!
    A company call Bank smart, That looked into a PPI claim for me a few years ago. The last i knew about my PPI claim was that i was not entitled to any PPI. Since then i have moved house and have not heard anything from then. Untill a company called MilCollection's emailed me about this, At first i just thought this was just a scam/span as the emails would be going into Junk mail. After the 3rd email this month in sept 2020. I called to see what this was about. This is when i found out about that I owe money to smart bank. I have now emailed both compancys asking for more information. I have asked for contact, brake down of fee's which they allege are payable, explanation of why any fee's are payable when they have failed to secure any refund and where it stated in the T&C.

    While I was on the phone to Milcollections, I got told that i must pay or else this will get sent to bailiffs and they have also said tthey can egt in contact with my work place and gets attachment of earning taken from my wages. (i didnt even know this is a thing that they are able to do)
    At the moment I so call owe £790, milcollection has asked me to pay £150 for the moment to stop anymore fee's. I have told them I'm going to look into this first as I have no idea what this payment is for. Im not sure what else to do, apart from wait & hear what they have to say.
    Im so worried right now as there is no way I can afford to pay this and dont want to pay not knowing what this is for. I do believe that the £790 is extra cost to send over to a third party, but i was not told this in the first place from bank smart that i needed to pay them anything untill 2020 - This claim was done over 3/4 years ago. Anyone else having these problems or know what else i can do!

    When you said your PPI claim was rejected, was it paid out but money used to offset old debts or anything like that or was it rejected and you got nothing as you weren't miss-sold / didn't have PPI?

  • I didnt have any miss - sold PPI. They just looked into and said that i didnt have any. and that was it case closed, well i thought it was untill 2020 would they are telling me i owe them money. But for what??
