Fraudulent Transaction

Hi All
hope this is the correct forum for this question.
I have a "bad credit" credit card, which I have never had problems with.
Last year a fraudulent transaction happend in which someone used my details to place a fast food order (!) which took me over my credit limit and I incurred fees.
As soon as i was aware of this, I cancelled the card, spoke with the card company and had my money refunded.
Now however I have been told that as I cannot "prove" it was not me that made the order the case has been closed and the money has come off my card again (and fees)
I have all the paperwork, it was for a place in London (I live in Brighton)
No CCV number was provided
The telephone numbers are wrong
The customer was already "blacklisted"
I even have the address they delivered the food to!!
OK, it was only £40, but it was money I did not spend and I have no idea what direction I should now go in.
I assumed if a CCV number is not provided then that stops the transaction?
Im so angry that this has happend and that it could happen again unless I can provided "proof"
It was a Saturday night, I was at home alone, how can I PROVE it was not me?

Raise a complaint to the card company.
They need to prove, beyond reasonable doubt, that it was you, not vice versa.0 -
How has the money come off the card again when you have already cancelled it?
Of your three statements in bold, no, the CVV does not have to be provided, and I can't see what relevance the other two have.
But as zx81 says, the burden of proof is on the card issuer. Ask them what proof they have that you did authorise the transaction, and if you don't agree with what they tell you take it to the FOS.0 -

I was trying to say that the information I was provided with gives all wrong information, i.e address of billing(wrong) telephone numbers (wrong) the customer was a blacklisted customer with the vendor but the order still went through.
The CCV number was not provided but as you have said, that doesn't seem to matter.
The card company have just said there is "no evidence to suggest it was not me"0 -

This is a civil matter so the burden of proof would be on the balance of probabilities, not beyond reasonable doubt.
OP I would ask for a deadlock letter and take it to the ombudsman, with the information you have given I doubt you'll have any problem.0
