Deductions from deposit!

My son rented a property via an agency which is owned by the landlord himself and through which he lets several of his own properties.
He paid a deposit but was never given any information about this being protected and when he moved out about six weeks ago (all proper notices etc given) his deposit was returned a couple of weeks later less £375.00.

When he queried this as the flat was left in a cleaner state than when he moved in ( he has photos) he was told this was for re painting the flat, repairing faulty wiring - he complained about this when he was living there and it was never repaired and oven cleaning.

There was no inventory when he moved in and they refused to let him attend the check-out and he had to leave the flat unlocked on the last day and drop the keys at their office and the company who does the check-outs then went in about a week later, so it was left unsecured for a week!

My question is, is there anything he can do to claim this money back as he has now been sent the balance and there is no deposit company to dispute with??

i would be putting in writing asking who the deposit was registered with and what the details where

i would also then be putting in writing exactly what youve mentioned above and say that you feel this is all incorrect. Give then so long to reply( maybe 7 days) and then look at issuing a small claims court action
  • Thanks newbie1980

Yes, I think he needs to get it in writing to them, i think they are going to be difficult as they have so far refused to give in and maybe something more 'Official' may make them think twice.
We just weren't sure of the actual legal requirements and so on to quote to make it sound like we knew what we were talking about!!

We will definately push with court action if needs be, as they have been awful but if we do not have to get to that stage it would be preferable!
